M-battled BMW loses court battle to Nissan
The Federal Court of Appeal in Canada has ruled that Nissan is free to use the letter "M" when promoting its Infiniti M35 and M45 product range, in a two-year court case where BMW Canada has accused Nissan Canada Inc. of trademark infringement. Earlier this year BMW won an injuction that would prevent Nissan from using the "M" letter, but this was overturned on appeal on July 12.
When Infiniti originally unveiled the "M35" and "M45" models BMW expressed no objection. Only when Nissan Canada launched an advertising campaign announcing "the M is coming" did BMW executives raise some eyebrows and decided to take legal action.
BMW will now have to either petition the Supreme Court to hear the case or alternatively come to an agreement with Nissan, BMW spokesman Jochen Frey said on August 7.
You know, I was wondering why all the Infiniti M guys would give me the thumbs up as I passed.
Hmmm, I wonder if they think their M's are BMW's or they think my M's are Infiniti's. You would think the Roundel would give it away but maybe not.
I need to go make an appointment at Supreme Court and have them answer that question.
On the real, I know there are people that don't know the diference but DAMN!!!!

I think that BMW should just move on. By making it such a high profile issue, they have given Nissan/Infiniti too much publicity that their "M" cars do not warrant.

YUP!!
BMW has never been known for having smart lawyers. From the annoying and legally ineffective "lawyer's screen," to the inane warnings in its advertising ("Always wear your seat belt," "Do not exceed the speed limit," "Don't drink and drive," "Don't crash into the car in front of you"), almost everything the lawyers have advised BMW to do has been stupid, ineffective, a waste of time and generally silly.

You might very well think that, but I couldn't possibly comment.
I've always thought that BMW M and Nissan M were one and the same thing. I never realised the difference.

Hey! There is nothing wrong with Vegemite! As long as you don't rub it too hard after applying it, the stuff works as well as a clay bar.

What!,i have it on ALMOST EVERY THING! I have it that thick you could build bricks with it :eatdrink: :eatdrink: :mrgreen: A jar a week some times!
Was considering donating a few jars to the tincan foundation,one reason is it helps young body's grow,so i dont see why it wouldn't stop :old: from shrinking :grin: And since it might get used as a caly bar substitute all the more reasons 8-)

Maybe on Interlagos Blue and Wood Trim, but not on REAL paint!
